When should I publish my fictitious business name?

The best practice is to arrange for the publication of your fictitious business name as soon as you file it with the clerk or within 7 calendar days of filing. You have 30 calendar days from the date of filing that your legal must run at least one time within the required 4 times running with the paper.

What are the next steps if I miss the deadline for publishing my fictitious business name?

If you miss the deadline, you must file your fictitious business name with the clerk’s office again paying the required fees. We will not publish your legal if you are not within the time frame required for your publication to run in adequate timing of the filing date.

When should I expect for my proof of publication to be sent to the county clerk’s office?

After the final run, our office prepares the proof of publication and sends through the USPS to the clerk’s office for certification and filing. After certifying your proof, they will send it back to our office. This process is approximately 1 to 2 weeks from the final run to it reaching the clerk’s office.

When should I expect the proof of publication to be returned to me?

You should expect for your proof of publication to be returned to you approximately 4 to 6 weeks after the final publication of your legal. Once we receive the certified document back from the clerk’s office, we make a document for our records the proof and then mail it out to the address that you have provided in your submission to us for publishing your legal.

Can I send my filing in today and it gets published this week?

Once you submit your filing through our online services, email your documentation, or walk into our office, your publication will begin the following Thursday from the day that you come into our office. We must receive your submission by 12:00 pm Friday in order for the publication to start on the upcoming Thursday.

 

Can I publish my fictitious business name if I live outside of Riverside County?

Yes, however, if the business is located in Riverside County, you must file and publish in Riverside County.

Do I have to reside in Riverside County if I want to change my name?

You must file with the Superior Court of the City that you reside in, within Riverside County. You may publish your petition for name change filing with our publication.

When should I expect my proof of publication?

Between the second and third publication date. We provide you with the proof of publication prior to your court date. It is your responsibility to file the proof of publication with the court.

When should the final run take place?

5 days prior to your court date.
The fourth week must have at least 5 days prior to your court date.

Can I change my entire family’s name on the same petition?

There is no limit to the number of people listed for a name change that can be included on a petition. As long as everyone’s name is on the same petition, all individual names will be included in the publication.

The petitioner does not have to reside in Riverside County, only the deceased family member.

How long must my probate publication run?

3 weeks. After the final run, we will provide you with the proof of publication for the court.

Can the judge presiding over my case approve my publication if the estate is in another county, city, or state?

No. Probates must be filed within the county of the deceased’s residence.
